For this week’s assignment, you will write a 300-word minimum essay about criminal omission. Be sure to address all prompts and cite your sources in APA format. This is worth 100 points, so be thorough and give your best effort.

There are two kinds of criminal omission: the simple failure to act (usually the failure to report something required by law), and the failure to intervene to prevent injuries and death to persons or the damage and destruction of property. Both omissions are criminal omissions only if defendants had a legal duty to act, even if there is no actus reus requirement.

In your essay, please address the following:

• Define, compare, and contrast the “Good Samaritan” rule and the American bystander rule.
• Which rule is dominant in the United States?
• Which rule is best?
• Explain your position.

Please remember that your individual work should be paraphrased. This means you must write the paper in your own words. You must not simply find an article and cut and paste it and submit it as your assignment.
